This End User License Agreement ("Agreement") is entered into between the App Owner and any user ("User") who downloads, installs, or uses the Pulikon mobile application ("App"). By using the App, you are deemed to have accepted all terms of this Agreement.
1. Scope of License
Subject to the Apple App Store Terms of Use, the App Owner grants the User a non-transferable, non-exclusive license to use the App solely for personal purposes on Apple devices that the User owns or controls. The App is licensed, not sold.
2. Restrictions
The User may not reverse-engineer the App, attempt to access its source code, modify it, reproduce it, distribute it, or sublicense it. Sharing the App across multiple devices over a network is prohibited.
3. Subscriptions, Pricing, and Price Changes
3.1. The Premium/Business subscriptions offered through Pulikon are auto-renewable subscriptions billed through the App Store and are subject to Apple's applicable terms.
3.2. The App Owner reserves the right to change/increase the price of subscription plans at any time.
3.3. A price increase does not apply directly to users who already have an active subscription. In accordance with Apple's App Store policies and applicable consumer protection laws:
- Existing subscribers are notified of a price increase in advance through the App Store;
- If a user declines to accept the new price, they may cancel their subscription, and it will end at the close of the current period without the new price ever being applied to them;
- If a user takes no action (except where applicable law requires explicit consent), the subscription continues to renew at the new price.
3.4. New subscribers are billed at the price in effect at the time they subscribe.
3.5. All payments are processed through Apple's App Store billing system; the App Owner does not have direct access to payment information.
4. Auto-Renewal and Cancellation
Subscriptions renew automatically unless cancelled by the user at least 24 hours before the end of the current period. Cancellation is managed through the user's Apple ID account settings.
5. Intellectual Property
All intellectual property rights related to the App belong to the App Owner. This Agreement does not transfer any ownership rights to the User other than the license granted herein.
6. Third-Party Services
The App uses third-party infrastructure services such as Supabase and Apple StoreKit. No warranty is given that these services will operate uninterrupted or error-free.
7. Disclaimer of Warranties
The App is provided "as is" and "as available." The App Owner makes no warranties, express or implied.
8. Limitation of Liability
The App Owner's total liability arising from this Agreement is limited to the maximum extent permitted by applicable law, and in no event shall exceed the total subscription fees paid by the User in the preceding 12 months.
9. Termination
The User may terminate this Agreement at any time by deleting the App from their device. The App Owner reserves the right to suspend the User's access in the event of a violation of the terms of use.
10. Governing Law
This Agreement is governed by the laws of the Republic of Turkey. The courts and enforcement offices of Turkey have jurisdiction over any disputes.
11. Apple's Third-Party Beneficiary Status
Apple and its subsidiaries are not parties to this Agreement, but Apple, as a third-party beneficiary of this Agreement, has the right to enforce its terms against the User.
